Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, applications, and related services operated by Tapper.gg at https://tapper.gg (collectively, the “Services”). By accessing or using the Services, creating an account, or clicking to accept these Terms, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
Important: The Services may allow you to review content related to outbound SMS messages. You must comply with applicable laws (including telemarketing and messaging laws such as the U.S. Telephone Consumer Protection Act (TCPA) where applicable), our rules, and any instructions we provide. These Terms include an arbitration provision and class action waiver in Section 15.
1. Eligibility and accounts
You must be at least 18 years old, capable of entering a binding contract, and a bona fide resident of the United States (including its territories, as we may allow) to register and use the Services as a tapper or to earn points or rewards. By creating an account, you represent and warrant that you meet this residency requirement. We may suspend or terminate accounts if we reasonably believe you do not reside in the United States. You may maintain only one account unless we expressly authorize otherwise. You agree to provide accurate, current information and to update it as needed. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at legal@tapper.gg if you suspect unauthorized access.
2. Description of the Services
Tapper.gg provides tools that allow users to participate in a human review workflow for queued outbound SMS messages by indicating approval (for example, through a tap or similar action). Message content, recipient identifiers, and related metadata may be shown to you solely to perform this workflow. We do not guarantee message availability, queue depth, uptime, accuracy of displayed content, or any particular outcome from using the Services. Features such as points, leaderboards, and rewards may change, be delayed, or be discontinued.
3. Points, rewards, and payouts
- No guaranteed value. Points, credits, or similar balances displayed in the Services are promotional loyalty mechanics unless and until redeemed through an official Tapper.gg redemption process we make available. Unless we expressly state otherwise in writing, points have no cash value, are not your property, and are not transferable, assignable, or redeemable except as we permit.
- Changes. We may change earning rates, redemption options, program rules, or discontinue rewards programs at any time, with or without notice, subject to applicable law.
- Forfeiture. Points and eligibility for rewards may be voided, clawed back, or forfeited if we believe you violated these Terms, engaged in fraud or abuse, or if your account is suspended or terminated.
- Payout information. If you provide payout identifiers (such as PayPal, Venmo, or Cash App details), you represent that the information is accurate and that you are authorized to receive payouts. Payouts may be subject to verification, tax reporting, minimum thresholds, and additional terms we provide when redemption is available.
- Taxes. You are solely responsible for any taxes associated with rewards or compensation you may receive.
4. Independent contractor; not employment
Your relationship with Tapper.gg is that of an independent participant using a self-service platform. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship. Participation is voluntary. We do not guarantee tasks, earnings, assignments, or any minimum level of activity or compensation.
5. SMS content, confidentiality, and messaging compliance
- Confidentiality. You may see message content and recipient information that is not public. You must not copy, screenshot, record, store, publish, sell, or disclose that information except as strictly necessary to use the Services as intended. You must not contact recipients, use the information for marketing, or use it for any purpose outside the Services.
- Your approvals. When you approve a message through the Services, you understand that your action may cause or contribute to an outbound SMS being sent by systems connected to the Services. You agree to follow our policies and applicable law and to refrain from approving messages you know or should know are unlawful, fraudulent, harassing, or otherwise prohibited.
- TCPA and related laws. Compliance with the TCPA, FCC rules, carrier guidelines, and other messaging laws often depends on facts outside our control (including consent obtained by message senders). You acknowledge that Tapper.gg is not a law firm and does not provide legal advice. Message senders and downstream systems may have separate compliance obligations.
- No endorsement. Display of a message in the Services does not mean Tapper.gg endorses its content or the sender.
6. Acceptable use and prohibited conduct
You agree not to:
- Use bots, scripts, autoclickers, or other automation to interact with the Services or manipulate points, sessions, or leaderboards;
- Attempt to bypass security, probe or scan systems, or access data or accounts without authorization;
- Impersonate another person, misrepresent your affiliation, or provide false registration or payout information;
- Harass, threaten, or harm others, or use the Services for unlawful purposes;
- Reverse engineer, decompile, or attempt to extract source code or models from the Services except to the extent such restriction is prohibited by law;
- Resell, sublicense, or commercially exploit the Services without our written consent;
- Circumvent a suspension or ban (including by creating new accounts).
7. Intellectual property
The Services, including software, branding, logos, text, graphics, and overall look and feel, are owned by Tapper.gg or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use in accordance with these Terms. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Services.
You retain ownership of content you upload (such as a profile image), but you grant Tapper.gg a worldwide, royalty-free license to host, store, display, and use such content to operate and improve the Services.
8. User content and DMCA
If you believe material on the Services infringes your copyright, you may send a notice to legal@tapper.gg with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512). We may remove or disable access to material in appropriate circumstances.
9. Suspension, termination, and enforcement
We may suspend or terminate your access to the Services, remove content, or adjust points or account status at any time, with or without notice, if we believe you violated these Terms, pose a risk, or if we need to comply with law or protect the Services. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, indemnity, arbitration, and governing law) will survive termination.
10. Disclaimers
To the maximum extent permitted by law, the services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components, or that messages or rewards will be delivered or available.
11. Limitation of liability
To the maximum extent permitted by law, in no event will tapper.gg or its affiliates, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the services or these terms, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the services or these terms will not exceed the greater of one hundred u.s. dollars ($100) or the total amount we paid you (if any) in the six (6) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless Tapper.gg and its affiliates, and their respective directors, officers, employees, and agents, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms or applicable law; (c) your approvals of messages or interactions with message content; or (d) your content or account activity.
13. Changes to the Services or Terms
We may modify the Services or these Terms at any time. If we make material changes, we will provide notice in a reasonable manner (for example, by posting an updated Terms with a new effective date, or by email if we have your address). Your continued use after the effective date of changes constitutes acceptance. If you do not agree, stop using the Services.
14. Governing law; venue
Except for the arbitration agreement below, these Terms and any dispute arising out of or related to the Services or Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law principles, unless a different governing law is required by applicable consumer protection law in your jurisdiction.
15. Dispute resolution; binding arbitration; class action waiver
Informal resolution. Before filing a claim, you agree to contact us at legal@tapper.gg to attempt to resolve the dispute informally for at least thirty (30) days.
Arbitration. If the dispute is not resolved informally, you and Tapper.gg agree to resolve any dispute, claim, or controversy arising out of or relating to the Services or these Terms (including their formation, interpretation, or enforcement) through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as provided below. The arbitration will be conducted in English. The arbitrator’s decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
Class action waiver. You and Tapper.gg agree that disputes must be brought on an individual basis only, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both you and Tapper.gg agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of class proceeding.
Exceptions. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information. Either party may bring an individual action in small claims court if the claim qualifies.
Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@tapper.gg within thirty (30) days of first accepting these Terms, including your name, email, and a clear statement that you opt out of arbitration. If you opt out, the class action waiver still applies to the maximum extent enforceable under applicable law unless prohibited.
Some jurisdictions do not allow certain arbitration or class waiver provisions. If a court or arbitrator holds that a portion of this Section is unenforceable, the remaining portions remain in effect.
16. Export; sanctions
You may not use the Services if you are prohibited from receiving U.S. products or services, or if you are on any government restricted party list. You represent that you are not located in a country subject to a U.S. embargo or designated as a “terrorist supporting” country and that you are not listed on any U.S. government list of prohibited or restricted parties.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Tapper.gg regarding the Services and supersede prior agreements on the subject.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No waiver. Failure to enforce any provision is not a waiver.
- Severability. If any provision is invalid or unenforceable, the remaining provisions remain in effect.
- Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
